What Is Considered Road Rage in California?
Road rage involves aggressive, hostile, or reckless driving behavior that puts others in danger. While everyday frustration behind the wheel is common, road rage crosses a clear line. It includes intentional acts that create serious risk and frequently violate California traffic and criminal laws.
Common examples of road rage include:
Aggressive tailgating
Excessive speeding or dangerous lane weaving
Cutting off other drivers or refusing to yield
Blocking lanes to prevent merging or passing
Sudden brake-checking without justification
Shouting, threats, or obscene gestures
Throwing objects or brandishing a weapon
Intentionally ramming or striking another vehicle
Physical confrontations outside the vehicle
Road rage is not a momentary lapse in judgment. It is dangerous conduct that can cause severe injuries, property damage, or death.
Under California law, these actions may result in criminal charges such as reckless driving, assault, criminal threats, vandalism, or assault with a deadly weapon when a vehicle is used aggressively.
Criminal Charges vs. Civil Liability from Road Rage
Road rage can result in both criminal charges and civil liability, two very different legal outcomes with very different purposes.
Our experienced personal injury attorneys in LA help clients understand options and next steps for pursuing compensation after a road rage incident.

How the Two Interact?
It’s common for a driver to face both criminal charges and a civil lawsuit at the same time. For example, a driver arrested for assault may also be sued by the victim for medical bills and emotional trauma.
While the criminal system determines guilt and punishment, your civil case with Prestige Law Firm P.C. is where you may be able to pursue damages and seek financial relief through a civil claim.
Even if a criminal case is underway, it’s critical not to rely on it alone, because criminal penalties do not guarantee compensation for victims.
Contact us to discuss options for holding responsible parties accountable and pursuing compensation supported by the evidence.

California Laws That Apply to Road Rage
California law views road rage as both a criminal offense and a civil wrong. That means an aggressive driver can face criminal prosecution from the state and also be held financially liable in a lawsuit brought by the victim.
Road Rage as a Criminal Offense
Road rage often begins as reckless driving, which is prohibited under Vehicle Code §23103 when a driver operates a vehicle “in willful or wanton disregard for safety.”
If the behavior includes speeding or weaving through traffic, prosecutors may also rely on Vehicle Code §22350, California’s basic speed law, or Vehicle Code §22109, which may apply when a driver stops or suddenly decreases speed without first giving an appropriate signal when there is an opportunity to do so.
When road rage escalates into violence, it may be charged as:
- Assault under Penal Code §240 and battery under Penal Code §242
- Assault with a Deadly Weapon (using a vehicle aggressively) under Penal Code §245
- Criminal Threats for verbal or gestured threats under Penal Code §422
- Vandalism if property is damaged under Penal Code §594
If a driver flees after causing harm, hit-and-run laws (Vehicle Code §20001) impose serious penalties. In fatal crashes, Vehicle Code §20004 requires immediate reporting to authorities.

Who Can Be Held Liable?
Liability in a road rage accident may extend beyond the aggressive driver. Depending on the circumstances, multiple parties can be held legally responsible.
Potentially liable parties include:
The aggressive driver for reckless or intentional conduct
Vehicle owners under California permissive use laws
Employers if the driver was acting within the scope of employment
Government entities when unsafe road design, signage, or maintenance contributed to the crash
Other negligent parties such as those responsible for vehicle defects or hazardous conditions
When a driver’s conduct is especially egregious, such as intentionally using a vehicle as a weapon, brandishing a firearm, or acting with malice or conscious disregard for safety, California law may allow punitive damages. These damages are meant to punish extreme misconduct and deter similar behavior, on top of compensating the victim.
Identifying potential liable parties and available coverage can affect the scope of a claim. Prestige Law Firm P.C. investigates cases to identify potentially liable parties and available sources of recovery.
