How long do I have to file a motorcycle accident claim in California?

Generally 2 years for personal injury (CCP §335.1). Claims involving a public entity (e.g., dangerous road, poor maintenance) often require an administrative claim within 6 months (Gov. Code §911.2). Deadlines vary, ask us right away.

What if I wasn’t wearing a helmet during the crash?

California law requires all riders and passengers to wear helmets (CVC §27803). Lack of a helmet may affect comparative fault and damages but doesn’t automatically bar recovery. We’ll address medical causation and apportionment with experts.

Can I still recover if I was partially at fault?

Yes. California follows pure comparative negligence, so your recovery is reduced by your percentage of fault, not eliminated.

Will my case go to trial or settle?

Most cases settle after investigation and negotiation. If the insurer won’t be fair, we litigate and prepare for trial.

How do attorney fees work?

No fees unless we win. You pay nothing up front; our fee is a percentage of the recovery, discussed and agreed upon in writing at sign-up.
